My Mother received a pension from a past employer until here death which paid for her Nursing Home care. She was on Medicare assistance also due to her lack of funds. When my step-father passed away 2 1/2 years prior to her the pension plan was supposed to be informed on his passing which would reduce her benefits, I was not aware of this and at that point she was very sick with dementia and Parkinson's and was not able to inform me of this. I was never notified by the Employee pension fund of this and recieved the checks as usual and every year filled out the paperwork for her State Medicaid benefits stating that her husband was indeed no longer living. I was her POA. Am I responsible for the overpayment they say they paid to her of 2,700.00 which they have just informed that we owe?
