The federal Fair Debt Collection Practices Act (FDCPA) gives a collector the right to call the friends and relatives of a debtor if the collector cannot locate the debtor because he does not know the debtor's phone number and/or address. If the collector knows how to contact your sister and calls you anyway, then he has violated the FDCPA.

The law also says that when the collector contacts you about your sister's debt, he cannot tell you that he is a debt collector although he must state his name. Also, he cannot tell you why he is calling or discuss the details of your sister's debt. In addition, once the collector has contacted you for the first time, he cannot contact you again unless he believes you have new information about your sister or that you gave him misinformation the first time he called you.

So, if a debt collector contacts you even though he knows how to get in touch with your sister or if the collector tells you he is a collector and that your sister has a past due debt that he wants to collect, the collector has violated your sister's legal rights. rights. She should contact a consumer law attorney for advice. They may even help her for free.

Before your sister makes this call however, it would be best for you to create a written log of when the collector calls you (date and time) and what the collector says during each call. Your sister will need to share this information with her attorney.
