debt collectors and medical bills

If you can pay any amount toward medical bills that should be accepted without going to a collection agency. If you have only $2 per month you are trying and that should be accepted as paying on bill. It's funny some people pay nothing and that's OK.

I called them, they never contacted me back. Now what?

I made several attempts to contact the debtor, phone calls and emails, they never responded. I can afford $25 every two weeks, I notified them of that, too. They never responded. Now they have sent it to a collection agency.

I was finally able to get someone from the medical agency on the phone but of course now they don't have the information. I am awaiting a call from the supervisor but am not impressed with their customer service or lack of.

Any suggestions? I really don't want to deal with the collection agency.

Not So Fast

As of May 2012 the AHA has released a billings guideline that many need to read. The suggestion that a medical entity can on a whim change an agreement of payment, disregard a lower payment and then write off an account and send you to collections is preposterous. This is the very thing the AHA is trying to avoid in revising billing and collection guidelines. Medical expense is not a luxury item one chooses on line, at a dealership or at the mall. It is a reluctantly needed service during a time of health crisis. We are at the mercy of a ridiculous cost of which we have very little knowledge knowing the actual sliding scale. We aren't handed a menu to select the cheapest cut. Therefore it would be with great audacity to suggest a person revising a monthly medical payment is equal to paying a revised car payment of 1.00. We knew heading to the car lot what we could afford.

If the patient has shown good faith in making a payment that alone demands respect. Via the AHA billings guideline this is addressed and the hospital should have written, contacted, and communicated a desire to address payment changes before taking extreme collection measures. Collection procedures should have been clearly communicated to the patient. Was any bill showing you were in breach of contract and the result would be possible third party collection? The goal of every hospital is to create an ethical and respectful relationship with the community. Not treat them as money.

The Affordable Care Act does provide some new consumer protections. They apply to nonprofit hospitals only and require those hospitals to provide patients with the written information about their financial assistance policies. In addition, these hospitals cannot take extraordinary collection measures until patients have had the opportunity to apply for this financial assistance if they believe they are eligible. These are relatively new protections and it will be interesting to see how they actually work once hospitals fully implement them. Thanks for your comments.

When you had a contract with medical vendor, paying them the amount agreed, and they cashed the checks...not crediting the correct account, and places you in collections because they said we put the wrong service date on check memo area, they placed us in collections. I have a HSA account, personal health savings, and medical office treated as a third party insurance payment. They used STARKS LAW...I still think there is some grey area of patients making good faith payments in accordance to their salary. I have filed OCR...Am I still considered the victim by being honest on what I could budget for payments? The for-profit versus non-profit medical offices have different policies. Non-profit normally allow you to make lower payments, FOR PROFIT, have no problem putting you in collection. In summary, profit based medical offices lose the patients...

Pamela: If you had a written payment agreement with the medical provider, you have lived up to the agreement and even so, your account was turned over to a collection agency, then I recommend that you schedule an appointment with a consumer law attorney in your area who helps people resolve their debt collection problems. You may have grounds for a lawsuit.

Your bill was payable in full when you received it and if you were not able to pay it, you were not entitled to decide for yourself how much you would pay the medical provider each month. That is something you should have worked out with the provider and gotten in writing. Since you did not, the provider was entitled to turn your debt over to a collection agency.

At this point, you can contact the collector and try to work out a payment plan. If you do, be sure to get all of the terms of the plan in writing before you begin making your payments.
