Will they take my husbands taxes

by kelly
(worcester ma)

I have student loans that have defaulted a few years ago and they always take my tax refund... This year i am married and did not work will they take his tax refund?

Reply from DebtCollectionAnswers.com:

Yes, sometimes joint tax refunds are intercepted to pay student loan refunds for spouses that are in default. If that happens your spouse can file for Injured Spouse Relief. But that's after the fact. Unfortunately, we aren't tax experts and don't know what steps you can take to avoid this other than adjusting your withholding to avoid a refund! You'll need to talk with a tax advisor.
