If I was 18 at the time of the debt but my mother was listed as responsible party and fails to pay, can they collect from me?

It is my understanding that in CA you are considered a legal adult when you reach the age of 18 unless you are still in high school. Therefore, if you were in high school at the time the debt was incurred, you cannot be held legally responsible for it at all. However, if you were not in high school, I believe you can be held responsible if your mother does not pay the debt even if she indicated that she was the responsible party.

To be 100% sure that I am correct, I recommend that you contact a consumer law attorney in your area who helps resolve debt collection problems. I am not an attorney nor am I an expert on CA law. Your initial meeting with the attorney should be free.
