by Will
(Houston, TX USA)

What is the time frame on a past due account balance before it's turned into collections? 30, 60, or 90 days?

how long until accounts are sent to collections
by: Gerri and Mary

Thanks for submitting your debt collection question on our Q&A page.

Past due credit card debts are typically turned over to collections when they are 180 days past due. For other types of debts, the creditor or service provider will set its own policy, but we don't usually see debts turned over to collections until at least 90 days have passed with no payments. If you tell us a little more about your situation in the comments field, below, perhaps we can help you understand your options for dealing with this debt.

past due martial arts
by: Anonymous

i was on the final month of a martial arts contract taking jiu jitsu. On the final payment i am 50 days late, i have stayed in contact with the owner and have made it clear that i would pay all late fees. Out of the blue in a response to my email stating i was working on the money he merely states its been turned over to collections. No written notice, no nothing. He has my facebook info,my phone number and could leave voice mails at anytime. Nothing was said to me stating he was getting ready to turn it over to collections. I made offer to come pay it same day he sent me the email response and was told "no, you have to deal with the collections now" Is this legal after only a month and a half with no warning? The contract states nothing about time frame on collections.

We aren't aware of any federal law that prevents a creditor from turning an account over to collections if you are in default. Nor are we aware of any requirement to notify you in advance before turning it over to collections. However, we are not attorneys so you may want to check with one.
