If the creditor has a judgment against you for the money that you owe, the creditor could get the court's permission to seize money from you bank account to pay the judgment and if your tax refund were in that account, then the creditor could end up with those funds. However, the creditor is not entitled to take your tax refund before it's deposited in your bank account.
