In most cases, for most types of debt, a creditor or cannot attach your Social Security benefits. In most cases, pension benefits are also protected from creditors. We recommend you talk with a consumer law attorney to make sure that your benefits are safe. One option would be to a free consultation with a bankruptcy attorney who can answer your questions.

If, however, a debt collector or creditor has already threatened to garnish your Social Security payments, then we would recommend you talk with a consumer law attorney with expertise in debt collection cases. That may be an illegal threat, and if that's the case, you may be entitled to damages and attorney fees if you successfully pursue this.
