US based collections agency trying to collect a uk student loan

by Ally
(Denver, CO)

My wife moved here from the UK and now a us based collections agency is trying to collect the defaulted loan from the UK (15 year old debt).
Is this actually legal?
If she were to file Chapter 7, would this discharge the debt?
I know in general student loans are not dischargeable, however this is not a debt originating in the US.

Thanks!

I am afraid I do not know anything about debts incurred in another country, although I imagine that your wife would not be able to discharge her UK student loan debt by filing for bankruptcy in this country. I think your best alternative is to schedule an appointment with a consumer law attorney in your area who helps people resolve their debt collection problems to find out what your wife's rights are in regard to her debt and how best to deal with the situation. An initial consultation with a consumer law attorney should be free.

Statute of limitations differ state by state and country by country. It would depend on the laws of the UK where she originally got the loan.
