Taking my Money

(Cedar City, Utah USA)

Capital One came in and took all my money out of my bank accounts. I still need a way to pay my bills. If I put all my money in a pre-paid credit card, can they come in and take that too?

money from bank accounts
by: Gerri

Thanks for submitting your debt collection question on our Q&A page.

Typically, before a credit card company can take money from your bank account to collect a debt you owe, it must first take you to court and win a judgment against you. I assume this credit card company has a judgment against you?

If so, I would recommend you find out what the procedure is for you to go to court and request the judge limit the amount of money the credit card company can take from your bank accounts, so that you can pay your bills. If you can't seem to get an answer from the court where your judgment was entered, another good option would be to request a free consultation with a bankruptcy attorney who can explain your rights and help you understand your options.

Please do let us know how this turns out for you. You can use the comments field below to give us an update.
