Stripping Junior Liens in NY

by maria
(nanuet, ny usa)

I have acquired 7 junior liens. I declared bankruptcy in the state of new york in august of 2009 and received a discharge in November of 2009. The judgments were placed against my home. I would like to know if there is any such thing called junior lien stripping in NY when you declare bankruptcy.
Thank you, maria

Lien stripping
by: Gerri

Maria,

To our knowledge, lien stripping on a residential mortgage usually takes place during a Chapter 13. But since we aren't bankruptcy attorneys, we can't comment on how it would work after the fact. We assume you had a bankruptcy attorney help you file. If so, you should consult with him or her. If you did not file with the help of an attorney (something we do not recommend, by the way) then you can go ahead and set up a free consultation with a bankruptcy attorney to see what your options are.

Hopefully you'll be able to find a solution here.
