Spouse needing answer

by Anonymous
(Woodbridge, va)

My husband has a debt for 8,000 dollars that he has not been paid due to major financial stress that we have been going through. The Debt collector put a legal hold on our joint banking account for this debt and the account is now in negative standing of 8,000 dollars. Can they do that if my name is on the bank account and i have nothing to do with the loan as far as co-signing or my name being on it? Because my paychecks are directly deposited into that account and i have no access to my funds.

Reply from DebtCollectionAnswers.com:

Since this is a joint account - you both own it equally - your funds are at risk for your husband's debts. You need to talk with a bankruptcy attorney right away to learn if there is anything you can do to get your money back. As a general rule, we recommend consumers do NOT keep joint accounts with someone who is going through financial difficulties.
