Can you be sent to a collection agency if you are making payments on a debt?

Thanks for submitting your debt collection question on our Q&A page.

Unfortunately, there is a misconception that a debt cannot be sent to collections if you are making payments. But anytime an account is in default, you run the risk of it being sent to collections.

If, however, you had an agreement that the account would not be sent to collections if you made the payments, or if you had an agreement that the account would be out of default if you made the payments, then it may be a different story.

I would encourage you to at least read the first chapter of Debt Collection Answers online for free. It would be good for you to at least have an overview of your rights when dealing with this debt collector.
