Sallie Mae Third Party ACT Debt Dollectors

by David
(Washington, DC)

Does a 3rd party have the right to garnish my wages for Sallie Mae who claims I owe them 21K from over 12 years ago? I paid them of in full in 2001 with a different collection agency that agency never gave them notice now they are saying that I still owe them! I do not have the paperwork as I have moved several times since then.

How do I fight this?

Sallie Mae?
by: Anonymous

Is Sallie Mae for student loans? If so, unfortunately, there is no statute of limitations on student loans (they never expire). In fact, I think I just read somewhere that they can even take the money out of your social security when you retire.

However, there are certain things that you can do like ask them to put their demand in writing (something they must do by federal law). If they do so, then, you have 30 days to request that they provide you with validation of the debt. See what happens at that point. Sadly, if you don't have any paperwork and they do, it will be very difficult for you to get out of it much less prove that you, indeed, paid this already.

Good luck!
