privacy act violation by landlord

by april
(lexington, ne)

Can a landlord send a delinquent notice to a relative without written permission of the tenant? The relative is not on the lease and was not the co-signer.

Reply from DebtCollectionAnswers.com:

April - did a 3rd party debt collector send this notice, or was it the landlord who sent it? Debt collectors are not allowed, under the federal Fair Debt Collection Practices Act, to tell others about your debt. If this was sent by a debt collector, we definitely encourage you to get a free consultation with a consumer law attorney asap.

If the landlord sent that notice, then the FDCPA does not apply, but perhaps that are state laws that prevent the landlord from notifying others about your debt. You'll have to check with an attorney.
