No Christina, regardless of what some debt collectors may tell you, you cannot go to jail for not paying a pay day loan. They are telling you that in an effort to scare you so that you will pay the money they want to collect from you.

Unfortunately, although such threats are illegal under the federal Fair Debt Collection Practices Act, most of the collectors who threaten consumers with jail time if they don't pay their payday loans are calling from a foreign country. Therefore, they are beyond the reach of the law here in the U.S.

If you have a lot of past due debt, you may want to contact a consumer bankruptcy attorney to find out if bankruptcy is a good option for you and how bankruptcy could help you resolve your payday loan.
