Collection Agency opened account in my name

George, I understand your question as I am dealing with the same problem. Midland Credit Management bought an old Citi charge card account of mine (that was settleed and closed in 2002). Since 2005, they have reported to the Credit Bureaus that I opened a revolving account with them in 2005 and am delinquent.

I have called Citi, they say report it to State Attorney General, which I have - no help really. I was informed that there is no law preventing them from trying to collect the debt; however, if they are past the satute of limitations, they can not get a judgment. Which explains the tactic of making it appear as if the debt they bought is a new account It starts the SOL clock over. I don't know how to resolve this problem.

i have sent letters to the Bureaus only to have the debt disappear and reappear the following year. And now I am getting calls claiming my debt is now 5x greater than the original limit on the card.

We would definitely recommend you get free legal advice about your debt collection problem. If the collector is manipulating the dates to damage your credit, or trying to collect an amount you don't owe, then you may be entitled to damages.
