collecting old debt
by: Gerri

Charles,

How old is this debt? When is the last time you made a payment on it? What type of debt is it? The amount?

According to my sources, the statute of limitations in West Virginia run between 5 and 10 years, depending on the type of debt. If your debt is outside the statute of limitations, then you can simply write a letter to the collector telling them not to contact you again. After you do, they cannot contact you again except to take legal action. If the debt is indeed too old, they aren't likely to do that.

But if the debt is not outside the statute of limitations, then you need to figure out how you are going to deal with it. Can you negotiate a settlement? Do you need to talk with a bankruptcy attorney?

If you are not sure about the statute of limitations, or how to handle this debt collector, you can talk with a consumer law attorney with experience in debt collection cases. Learn how to get low cost or FREE legal help with your debt collection problem here.

Let me know if I can answer some additional questions.
