NOTIFIED BY PHONE OF SUMMON

I WAS NOTIFIED BY PHONE THAT I AM BEING SUED.IT WAS LEFT ON MY ANSWERING MACHINE.THEY SAID THEY WOULD BE OUT TO SERVE ME ON OR ABOUT THE 22TH OD SEPT. 2011 AT MY HOME.

QUESTION: IS THIS LEGAL? I AM IN THE STATE OF MICHIGAN.

THEY FURTHER SAID THAT I COULD CONTACT THE CREDITOR THAT IS OWED.THE PERSON ON MY MACHINE SAID THAT THEY WERE CALLING FROM THE SHERIFF'S PROCESS SERVER'S OFFICE.
IS THIS LEGAL?

I have never heard of a consumer being notified by phone that they will be served with a summons. However, that does not necessarily mean that the message you received is illegal. What would be illegal is if you were sued without being personally served with a summons.

I am not an attorney nor am I familiar with the rules and legal procedures in MI or your county of residence so I did not know if they provide for notification by phone followed by personal service. If you want to find out for sure, I recommend that you contact the court clerk's office in your county or contact a consumer law attorney in your area.
