NOTIFIED BY PHONE OF SUMMON

I WAS NOTIFIED BY PHONE THAT I AM BEING SUED.IT WAS LEFT ON MY ANSWERING MACHINE.THEY SAID THEY WOULD BE OUT TO SERVE ME ON OR ABOUT THE 22TH OD SEPT. 2011 AT MY HOME.

QUESTION: IS THIS LEGAL? I AM IN THE STATE OF MICHIGAN.

THEY FURTHER SAID THAT I COULD CONTACT THE CREDITOR THAT IS OWED.THE PERSON ON MY MACHINE SAID THAT THEY WERE CALLING FROM THE SHERIFF'S PROCESS SERVER'S OFFICE.
IS THIS LEGAL?

I have never heard of a consumer being notified by phone that they will be served with a summons. However, that does not necessarily mean that the message you received is illegal. What would be illegal is if you were sued without being personally served with a summons.

I am not an attorney nor am I familiar with the rules and legal procedures in MI or your county of residence so I did not know if they provide for notification by phone followed by personal service. Sounds like a Debt Collector trying to get you to call them. These tactics are illegal. The Sherif would never call to tell you that you are being served and then tell you to call the creditor.
