My Judgment Was Dropped - Why ?

by Sue
(Syracuse, NY)

I had a summons from a collection/Law office from a credit card i stopped paying on about a year ago, they did serve me a summons at my house and i received a judgment letter from the sheriffs dept and i started to pay $20-25 dollars a month for about 2 months and did not pay the following 2 months. I paid on the 5th month and the sheriffs dept sent the money order back to me. I called and they said the ppl (Lawyer group) dropped the judgment because they thought I was not working anymore. I am going to do chapt 7 bankruptcy as soon as i get my tax return $ to pay my lawyer. My only question is can any of the creditors/ collection law groups take my tax return???

Sue,

It it sounds like you've already consulted with a bankruptcy attorney. We would recommend you ask the attorney this question. He or she will be able to tell you what the judgment creditor can and cannot do to collect from you until you have filed.

Good luck. We hope you are able to get back on track.
