MY HUSBANDS DEBT

MY HUSBAND FILED CHAPTER 7 BANK. ABOUT 19 YEARS AGO. ONE OF HIS DEPTS WAS AT THE BANK WE DO BUSINESS WITH. TO START WITH IT WAS MY ACCOUNT TO START WITH, WE MARRIED ABOUT 12 YEARS AGO,I'VE DONE BUSINESS THRERE FOR 30 YEARS. THE HOUSE I OWNED BURNED IN FEBUARY AND THE MONEY WE RECIEVED FROM IT CAME IN BOTH OUR NAMES BECAUSE THE INSURANCE WAS IN BOTH OUR NAMES. NOW SINCE THE MONEY IS IN THE BANK AND HE FILED BANKRUPTCY ON THEM, THEY JUST TOOK THAT AMOUNT OUT OF OUR CHECKING ACCOUNT WITHOUT NOTICE OR ANTHING. THIS MONEY IS REALLY MINE FOR MY HOUSE THAT BURNED, HOW CAN THEY JUST GO IN AND GET WHAT THEY WANT. THE LADY I TALKED TO SAID SHE HAD EVERY RIGHT AND I COULD GET A LAYWER BUT IT WOULDN'T DO ANY GOOD. IT'S BEEN 19 YEARS AND THIS IS NOT MY DEPT. I DIDN'T EVEN KNOW MY HUSBAND AT THAT TIME. PLEASE HELP.

Sorry to learn about your troubles. I don't have an explanation for the bank's actions and I am not an attorney so I cannot provide you with any specific advice about what to do other than to contact an attorney right away to determine if the bank had the right to do what it did and if it did not what your legal options are. It would seem that if your husband filed for bankruptcy 19 years ago, the debt he owed to the bank would have been resolved through the bankruptcy. If your husband's bankruptcy attorney is still practicing law in your area, I recommend that you set up an appointment to see him or her.
