Jobless, can they take money from my bank account ?

by Bianca
(OH, USA)

Hi,

Here is my situation. I lost my job and I have a lot of debt, but I can't pay any of it, because I don't know how long (if) it will take me to get a job.
I have some money in the bank, savings and some stocks.
If the credit cards will sue me and most likely they'll win, will they be allowed to take money from my accounts, even if I don't have a job? I live in OH as now.

So sorry about the fact that you are going through tough times, Bianca. Hang in there!

In answer to your question, if your creditors sue you and win judgments against you, they can ask the court for the right to levy against the funds in your bank account to collect on the judgments, even if you are out of work.

Given your situation, I strongly urge you to consult with a consumer bankruptcy attorney. The attorney will evaluate your situation to determine what your options are for resolving your financial problems and will explain how filing for bankruptcy can help together with its drawbacks. Then you can decide if you want to file. If you qualify for a Chapter 7 bankruptcy, you will be able to wipe out all of your credit card debt and most other types of unsecured debt you may owe as well.
