Investment Management & Recoveries Inc. keeps harassing me with phone calls. I have disputed the claim, I have specifically instructed them to cease and desist. The last time the called, the female caller refused to identify herself. When I told her that they were not to call me again, she shouted, “I do not have to listen to you. You are not my father.”

Did you do all that you describe in writing? If not, I would do everything again in writing and make a copy of each of the letters you write so that you have a record of your actions. Send each letter certified mail with a return receipt requested.

If your problems persist after you send the letters, I recommend that you schedule free consultation with a consumer law attorney because the collection agency will have violated the federal Fair Debt Collection Practices Act. (By the way, if the attorney recommends that you sue the agency, the copies of your letters as well as the return receipts will be important.)

I also recommend that you print a copy of this Free Debt Collection Worksheet and use it to keep a record of any interactions you have with the collection agency. The information on the sheet may also be helpful if you file a lawsuit.
