In the Military, Can They Take My Pay?

by JD

I am in the army and currently in Afghanistan and want be back to the states til summer 2010. My question is this. My loving wife is refusing to deal with the bills and collection people. They are talking about going to my c.o. and having my military pay taken to settle the debt. Can they take my pay? I have heard that they would get all my monthly carry home til it was settled in full. Is this right?

I am sorry you are experiencing these problems. I spoke with someone who works in a financial counseling capacity with another branch of the service, and he said it was unlikely that they could garnish your wages while you are serving in active duty. You are likely protected by the Servicemembers Civil Relief Act.

I would encourage you to find out more about this law and how it protects you. http://usmilitary.about.com/od/sscra/l/blscramenu.htm
