I was served with a summons, I made a payment arrangment, but the agenct has not sent the info to the court and I am to appear in a week
(winter haven, fl USA)
I was served on 8/24 with a summons to appear in court. I didn't realize that I owed this debt. But long story short I called the debt collection number and set up a payment plan. I was told they would send me a certified letter for me to sign, to show the courts I have made arrangements and the case would be dropped. It's been 20 days and I haven't received the letter.
I called and they said they are running several weeks behind. I said that the court date is in 12 days what if they don't send the letter by then? the lady said to call the court and explain that I set up payments arrangements, but what good would that do coming from me if they haven't sent any information to the court?
Do I still need to appear, and tell them that I made arrangements, but they haven't sent the paperwork yet? Also they have my social security # wrong, does that play any part? Thanks

Lindsay...aggghh!! We would have advised you not to make any payments until they confirmed in writing that they would drop the lawsuit. But what's done is done.
You absolutely should show up in court to explain to the judge what happened. And you may want to talk with a consumer law attorney in advance to help protect yourself. You can contact a local consumer law attorney with experience in debt collection cases. Find out how to get FREE or low cost legal advice about debt collection from a consumer law attorney here.
