Hospital Bill went to Debt Collector for over 5,000.00

by Carrie
(Toledo, Ohio, United States)

A behavioral agency sent to a hospital out of state when I was under 18 years of age. The hospital did not accept either of my insurances. The hospital put my 5,000.00 bill in collection and I am wondering if I would be able to fight it or not? if so, what would be my first step?

Hospital bill in collections
by: Gerri

Carrie,

In many cases a contract with a minor cannot be enforced. If this were a music club subscription, for example, that you had signed up for under the age of 18, there would be a strong chance that they couldn't really do much to force you to pay.

However, in the case of a hospital bill, it's possible your parents or guardians could be held responsible for the debt if you were their dependent at the time. I don't know the details or your state's law regarding this type of debt, but it is a large enough amount of money that I would recommend you talk with a consumer law attorney to find out your rights.

The first consultation is often free, but be sure to ask. You can visit www.naca.net to find any attorney in your area to talk with.
