i received social security disabilty and a private pension in the state of va. i received a garhishment from captial one. can they garnish my payments and should i go to court

Social Security disability payments are exempt from garnishment by a credit card company so I recommend that you either contact a consumer law attorney in your area who has experience in debt collection cases right away. I also suggest that you read the first chapter of Debt Collection Answers online for free so that you have a good understanding of your debt collection rights.

I am not an attorney or an expert on Virginia law so I can not advise you about whether or not all or a portion of your pension is exempt from garnishment in your state. It would depend on the specifics of VA's property exemption law.
