Finance company giving information to my roommate

by linda
(toledo, oh, usa)

I owe on my car payment. I am waiting for them to come to repossess my car. The finance company has called and talked to my roommate about this. They have told her that they need to know where the car is or that I have to come in to pay my debt. Is this legal in Toledo, OH?

discussing debt with a roommate
by: Gerri

It is illegal under the federal Fair Debt Collection Practices Act for a debt collector to discuss your debt with a third party. They are allowed to call somebody else in order to locate you, but they should not be discussing the debt with that other person. In addition, once they have located you, calls to a third party must stop.

We suggest you contact a local consumer law attorney with experience in debt collection cases. Find out how to get FREE or low cost legal advice about debt collection from a consumer law attorney here.
