I had to go in front of judge and answer ? about my assets. Can they go after my wife's wages, 401k and here car? This is all my debt her name not on anything living in South Dakota thanks! roger

Roger,

Thanks for submitting your debt collection question on our Q&A page.

I assume you're going to court because you have been sued and a judgment has been entered against you. Typically, a spouse's income can't be tapped to pay the debt of a spouse who is not a cosigner.

As far as your assets go, a certain property is exempt (safe) from creditors. To be safe, I would really encourage you a free consultation with a bankruptcy attorney as soon as possible.

The attorney can tell you what the judgment creditor can and cannot go after to satisfy your debt. Even if you have no intention of filing, this consultation should answer your questions about what property is safe.
