Can medicare take the settlement checks from asbestos my deceased husband was receiving? His estate has been in probate for 7 years and Im being told I have to keep it in probate in order to receive those checks. Now I have received a letter saying medicare is keeping the lump sum settlement because he was overpaid.

I do not know enough about your situation based on the information you provided to be able to answer your question. I strongly recommend that you schedule an appointment with a probate law attorney in your area. I think an hour or two of the attorney's time will be money well-spent.
