Deceased Husbands Debts And Insurance Policy

by Dawnika
(Mesa,Arizona)

I live in Arizona where it is a community property state. My husband committed suicide last month and I have received medical bills in his name only. I also do not know if there are any other debts he incurred that maybe I don't know about. We had gone through a bankruptcy in 2009, do not own any property, nor have any money. The only assets I have is a Mazda in my name, paid off, and some furniture.

We bought a term life insurance policy on my husband in 1994. (He was the owner/insured, I was beneficiary); then we divorced in Aug. 1996, and he did not want the insurance policy so he signed ownership over to me. We remarried in Oct. 1996 and I still retained ownership of the policy.

Now, because, I owned the policy coming into the marriage the second time around, can my deceased husbands creditors come after that insurance money or not? Is it looked at as community property or separate property owned by me?

Thank you

We are so sorry to hear about your husband's suicide. We really wish we could answer your question but that's something you'll need to ask an attorney about.
