Debt Collectors taking money from wages and account.

by Maddie
(Oregon)

Can debt collectors garnish my wages and take money from my bank account at the same time? I voluntarily gave my car back due to the fact of not being able to make the payments. After they auctioned off the car, they came after me for remaining balance which I knew would happen. Well they are now garnishing my wages and have been for the last month and now are taking money from my bank account causing me not to be able to even pay any of my other bills! Can they take money from my wages and bank account at the same time?

Debt Collectors Taking Money From Wages and Bank Account
by: Mary

Thanks for submitting your debt collection question on our Q&A page.

Debt collectors are entitled to sue you for the money you owe. When they win their lawsuits, they get a judgment against you and among the ways that they may collect on those judgments is by garnishing your wages and levying your bank account. If those things are happening to you, then it's not surprising that you are having problems paying your bills.

Given the state of your finances, I strongly urge you to schedule a FREE consultation with a bankruptcy attorney. The attorney can help you figure out whether or not filing for bankruptcy would be the best way for you to resolve your money problems. I encourage you to take this step immediately. After all, the consultation is free, so you have nothing to lose by talking with the attorney and you'll be under no obligation to file. However, you will end up knowing more than you do now about what your options for resolving your financial situation and so you'll have a better sense of what you should do.

Please share what happens with your situation in the comments section for this question. We are very interested in hearing how this turns out for you, and your experience can help others who are struggling with debt collectors.
