Debt collector takes money for my moms debt

I'm 21 years old and received a letter asking me to pay an old medical bill. The date of service was Aug, 2005. Almost 6 years ago. I asked them what this bill was about and they told me it was a $25 dollar no show for an appointment. I was only 15 at the time and my mom must of set up the appointment. The bill with interest is now 128.00 dollars.

I went and talk to the original company and they said it was a mistake and should never have gone to me. They said they would correct it right away. One week later i received another letter again asking me to pay 128.00 from a collection agency.

I just received a letter from the state telling me they have offset my tax to pay a bill. How can i be responsible for paying a bill when i was only 15 years old at the time?

What can i do?

Debt collectors can't usually intercept your tax refund to collect except in the case of tax debts or student loans. (We're not saying it can't happen, but it would be unusual.) Are you sure that's the debt that they withheld from your taxes?

It probably makes sense to talk with a consumer law attorney to find out if this collection agency broke the law. Given that you were a minor at the time, and given the fact that this debt was disputed, it's possible the collection agency didn't act properly.
