Debt Collector cashing my checks late.

I have in writing from the Debt Collector on what dates my money would be taken out from my bank account and the amount. As of now they are 1 month behind and it is frustrating to me because I have to watch my money and practically guess when they will cash in my checks. The last check they cashed put me in the minus from my back account and now I'm paying overdraft fees. Is there anything I can do about this?

Your situation sounds very frustrating. While debt collectors can't cash postdated checks early, we aren't aware of any rules that prevent them from cashing them late. (We are not a fan of paying a debt collector by check, and yours is an example of another reason why we don't like that approach).

We suggest that you contact a consumer law attorney who helps consumers resolve their debt collection problems for advice about what to do. It will be helpful that you have your agreement with the collector in writing. Your first appointment with the collector should be free and you may get all of the information you need at the meeting.
