Credit cards wrote off debt now I might have to open a probate

The credit card companies wrote off my ,oms cc after she died since there were no assets. Mow a few months later I find some AFLAC policies that may pay out to her estate , this will cause me to open an estate due to the check being made out to the estate of ... My question is can or will the cc companies find out? And am I obligated to notify them ? They are no longer existing creditors thanks

Although the credit card companies wrote off the debt, your mother's estate still owes them money. Writing off a debt is simply an accounting measure used by companies to get bad debt off of their books. It's not a process for forgiving debt. Therefore, you probably are obligated to let your mother's credit card companies know that you've re-opened probate. However, I am not an estate planning attorney and do not know how probate works in your state. Therefore, I recommend that you contact one in your area or go here for help Ask Estate Lawyers Now.
