Collection on my late father's truck

by TOMMY
(SHAWNEE OK)

My dad passed away 8 years ago he had a pickup that they both owed on. can they garnish my mom's social security check?

Reply from DebtCollectionAnswers.com:

Tommy, Social Security income cannot generally be garnished or seized to pay consumer debts. In addition, it is our understanding that the statute of limitations for most consumer debts in Oklahoma is 3-5 years. So this debt may be too old to collect anyway.

If a debt collector is threatening your mom, or telling her she must pay this old debt or possibly lose her Social Security income, please tell her to get a free consultation with a consumer law attorney right away. Those threats may well be illegal.
