chase bank had summoned me to civil court

and 3 mo. later to general sessions!!!!!!

i live in Tennessee and SSDI is all my income. I cant afford bankruptcy. What will they do? To go to general sessions does that make me a criminal?

going to court for debt

Bill,

I don't know enough about what's going on to say why they are taking you back to court but in the US you are not a criminal just because you can't pay your debts. So please don't panic about this yet.

I know you can't afford a bankruptcy attorney, but you should at least find out from one if you are "judgment proof." If that's the case, you can explain to the judge when you go to court why you can't pay the debt and that you don't have any assets that they can go after.

In addition, I would encourage you to at least talk with a consumer law attorney with experience in debt collection cases. Find out how to get FREE or low cost legal advice about debt collection from a consumer law attorney here. You'll want to find out if what they are doing here is legal. Don't assume it is. There have been a number of cases against creditor and collectors where they have been found to be breaking the law in their collection efforts.
