Car reposession

by Linda
(okc, ok)

Can my husbands bank account have money taken out, for MY car repossession? I am the only one on the contract and I was not married at the time of signing, But we got married about a week before I gave the car back before it was paid off. I'm worried they will try to take money from his bank account for MY debt.

Repossession and your husband's bank account
by: Gerri

Linda,

Your husband's individual bank account should be safe. Oklahoma is not a community property state so I don't see any reason why a debt collector should be able to go after his account. However I am not an attorney so please don't take this as a definitive answer. (Plenty of consumer law attorneys can tell you horror stories of things debt collectors did that they weren't supposed to do).

If the judgment they have against you is for large amount and you are unable to resolve it, don't be afraid to at least get a
a free consultation with a bankruptcy attorney who can answer your questions and help you explore your options.

We hope you're able to find a way to put this behind you.
