Capital One

(Cedar City, Utah USA)

I went to court in February for a supplemental hearing and was told I was free to go because I didn't make enough money and received state assistance. Two days ago Capital One came and took every last penny out of my checking and savings leaving me with 12 bounced checks that put me hundreds in the minus on my checking account. One of these checks was for my rent and the others for other creditors I am trying to pay off.

Account in collections
by: Gerri

Credit card companies generally cannot go after your bank accounts unless they have taken you to court and obtained a judgment against you. We would strongly recommend you talk with a consumer law attorney with experience in debt collection cases. Find out how to get a consultation with a consumer law attorney here. If they broke the law in their collection efforts against you, you may be entitled to damages as well as collection costs and attorney fees.

We recently published a story on our blog about a consumer who won a $120,000 judgment against Capital One in a debt collection lawsuit. While his case was different, it illustrates how important it is to get expert advice if you believe a debt collector or creditor may have broken the law.
