Can't Pay Medical Bills. Will Our Income Be Garnished?

My husband is on Disability Social Security and I have a State Pension and Social Security. We have numberous medical bills but do not have the money to pay them. Can a collection agency take us to court and garnish our money??

Disability payments and Social Security payments are exempt from garnishment and most pensions cannot be garnished either. However if the collector sues you and gets a judgment against you, he could take put a lien on one or more assets you own, assuming that some of those assets are nonexempt assets (assets that cannot be taken to collect a debt).

If you do not own any nonexempt assets, then based on what you have told me, it appears that a collector with a judgment against you would have no way of collecting on it. Therefore, assuming the collector did his homework, he would realize that suing you would not be worth his time or money.
