Threat of wage garnishment

Debt collectors can't threaten to take any legal action they either cannot take or don't intend to take. If this collector threatened to garnish your wages if you don't pay in two hours, that may be an illegal threat. Wage garnishments typically require that the collection agency first take you to court, win a judgment than go after you wages.

We recommend you contact a consumer law attorney for advice. Under the Fair Debt Collection Act, a debt collector may have to pay damages plus attorneys fees when it breaks the law.

Since you are in California, you may want to contact attorney Robert Brennan, who is the coauthor of the California edition of our ebook Debt Collection Answers: How to Use Debt Collection Laws to Protect Your Rights. You can read the first chapter online for free - we hope you find it helpful!
