can s.s. take payment from s.s. if spouse pass away and what can i do to stop it?

if my wife recieved a over payment fromm s.s. and pass away before all is collected and now they stating that i have to pay back the over payment, the will take money from my s.s.for payment. my wife and i are two different account, how can they hold me accountable for over payment.

I am not a SS expert and so I cannot answer your question. I recommend that you call the SS Administration for an answer or that you schedule a meeting with an elder law attorney. Your initial appointment should be free. I do know however that you have a right to appeal whatever the SS Administration is telling you and that it's possible that your appeal could result in your not having to repay the overpayment. However, you must file your appeal within a certain amount of time after receiving the notice about the overpayment. Again, the SS Administration or an attorney will be able to provide you with information about the deadline and explain what your appeal rights are, how the appeal process works and so on.
