i am unemployed and have a judgement from a hospital bill, can they garnish my husbands paycheck for my bill that is only in my name?

Wisconsin is a community property state, which means that both spouses are legally responsible for the debts they run up together or separately during their marriage. Therefore, if the hospital has a judgment against you, it can ask the court's permission to collect on that judgment by going after your husband's wages. It can also try to collect by seizing money in your separate and/or joint bank accounts and by putting a lien on property that you own -- your home for example.

I don't know the size of the judgment or anything else about the state of your finances, but you and your husband may want to meet with a bankruptcy attorney about your situation. If you filed for bankruptcy, it would stop any efforts to collect the judgment from you and your husband.
