I live in Arizona. My husband's ex got a judgment that my husband is supposed to pay $6000 for HER attorney fees. This payment is now past due as he can't afford o pay it. Can she (the ex) garnish MY paycheck for this debt?

It depends. If the judgment is for a debt that your husband incurred before you were married or relates to some other legal matter that occurred before your marriage, then his ex cannot have your wages garnished if your husband does not pay the court judgment.

If the judgment relates to a debt or some other issue that occurred since your marriage, then the ex could come after you to collect on the judgment because AZ is a community property state and so spouses are equally liable for each others debts and other financial obligations. However, your husband's ex would have to get the court's permission to have your wages garnished.

If you have additional questions or concerns about this matter, I recommend that you consult with a consumer law attorney in your area who helps consumers resolve their debt collection problems.
