Can Debt Collector Take my Truck?

i am disabled and have an income of $800 a month. i have nothing left but my truck worth about 12.000 and is paid for. I am being sued for about 3.000 for med bills.
Can they take my truck.........thank you...Bruce

I am sorry to hear about the difficulties you are going through. If your sole income is disability, you may be what is called "judgment proof." That means that even if the creditor tried to sue you there would be nothing to go after.

That doesn't always stop a creditor from suing...sometimes they sue anyway so that they have a judgment in place in case your finances change in the future, but sometimes it does stop them when they realize they may be throwing good money after bad.

It is unlikely that they can go after your truck to satisfy unpaid medical bills, but the best thing for you to do is to check with a consumer law attorney or bankruptcy attorney who can help you understand the rules. The first consultation is often free, but be sure to ask. The attorney should also be able to help you decide how to respond to the lawsuit.
