Can Debt Collector Sue Me For 17 Year Old Debt?

by Devin
(Aurora colorado)

I had a debt that was written off 17 years back in 1993. Now i am being sued for that debt. Is that legal? Or can they sue me for the debt?

Reply from DebtCollectionAnswers.com:

If this is a consumer debt, then it's very likely that the debt is outside the statute of limitations. In some states, a collector can sue after the SOL has expired but you can raise that as a defense against the lawsuit. In other states, trying to sue for a time-barred debt is illegal.

We would encourage you to at least talk with a consumer law attorney with experience in debt collection cases. Find out how to get FREE or low cost legal advice about debt collection from a consumer law attorney here.

Also take a moment to read our page about being sued by a debt collector.
