Can collector refile on my credit report?

by Christina
(Utah)

I have disputed a collection account listed on my credit report to all three credit bureaus. They have all deleted the account, but the collection agency continues to call me. Can they refile or sue me if I send them a cease and desist letter or can they refile on my credit report?

If you have successfully disputed an item on your credit report and it has been removed, it is not supposed to reappear on your credit reports unless the collector certifies that it's correct and the credit reporting agency notifies you in advance. I'd suggest you keep a file with documentation showing that the items were removed, just in case they ever do appear again in the future and you aren't properly notified.

Sending a cease and desist letter to the debt collector should not cause this information to be reported again. And sending one of these letters is your right under federal law, so if you think it applies to your situation, that I wouldn't let your worries about your credit reports stop you from proceeding.

We hope this helps!
