The federal Fair Debt Collection Practices Act (FDCPA) establishes who a debt collector can and can't talk to about money that you owe. And that law saws that a collector can discuss your debt with your spouse. It's possible however, that there is a law in your state which says that a collector cannot talk to your spouse unless he or she is legally liable for the debt. For example, your spouse signed for the debt along with you. In that case, your spouse is as legally obligated to pay it as you are. If such a law exists, than it takes precedence over the FDCPA.
