Am I Responsible For Late Husband's Debts?

by Sandra
(Wachington DC)

I just recently married my husband 3 months ago. He passed away this week. I know he had some hospital bills that were not yet paid prior to our marriage. Am I responsible for those bills since we were married before he passed away? We were married in the state of Virginia and I know that all states have different laws too. Please help.

Your Husband's Debts

Sandra,

We are so sorry to hear about your husband's death. It must be such a stressful time for you.

Please read our deceased person?s debt FAQ for more information.

Virginia and Washington DC are not community property states. Typically, in states that are not community property states, individuals are not liable for their spouse's debts unless they are joint debts.

If your husband left an estate, the creditors are entitled to try to collect from the estate, but if there is nothing to pay the bills, then they are probably out of luck.

We can't offer legal advice, so please don't take this as such. We do offer our condolences, however.
