9 year old debt resurfaced

by phillip
(san francisco, ca)

I have a debt from 2002 that fell off of my credit report in 2009 that a new debt collection agency is now sending me letters to pay for it. The debt was unpaid when it fell off of my report. Can this happen?

They can ask you to pay, but depending on the statute of limitations, they probably can't sue. Keep an eye on your credit reports to make sure they're not trying to report it as a 'new' debt. (The statute of limitations starts clicking the first day the account is delinquent. Buying and selling the debt does not change that.)

You might wish to consult an attorney, at least to confirm your rights and check on the statute of limitations.
